Welcome to Prosper app!

These Terms and Conditions ("Terms") govern your use of the Prosper application, including the mobile apps and web app (collectively, "the App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. General Use

Prosper is a tool designed for conducting mathematical simulations in a financial context. The App allows users to input various financial parameters to generate visual representations of potential financial outcomes. The App is intended for educational and informational purposes only and should not be relied upon as financial advice.

2. No Financial Advice

The App is not intended to provide, and does not constitute, financial advice, investment advice, or any other kind of professional advice. The simulations generated by the App are based solely on the inputs provided by the user and are intended to be illustrative examples of potential outcomes. Users are advised to consult with a qualified financial advisor before making any financial decisions. Prosper and its developers do not guarantee the accuracy, completeness, or usefulness of any information generated by the App.

3. Mathematical Errors and Biases

While the App strives to provide accurate simulations, there is a possibility that mathematical errors, computational biases, or other inaccuracies may occur. These could result from a variety of factors, including but not limited to incorrect assumptions, software bugs, or limitations in the App's algorithms. Prosper and its developers are not responsible for any errors, omissions, or inaccuracies in the simulations.

4. Assumptions and Limitations

The simulations provided by the App are based on certain assumptions and limitations, which may not reflect real-world conditions. These assumptions may include, but are not limited to, static interest rates, fixed inflation rates, and other economic factors that can vary over time. The App does not account for unforeseen events, market volatility, or changes in user circumstances. Users should be aware that the outcomes generated by the App are hypothetical and may differ significantly from actual financial outcomes.

5. User Responsibilities

Users are responsible for providing accurate and complete information when using the App. The accuracy of the simulations depends on the quality of the data provided by the user. Users are also responsible for interpreting the results of the simulations and for making their own financial decisions based on those interpretations.

6. User Accounts and Security

In order to use certain account-linked features, including premium purchase recovery across sessions or devices and cross-device data sync, you may choose to create an account. Accounts can be created or accessed using an email address and password, Sign in with Google, or Sign in with Apple. You are responsible for maintaining the confidentiality of your login credentials and for activities that occur under your account. Prosper reserves the right to suspend or terminate accounts that violate these Terms or involve misuse of the App.

Signing in may also trigger a subscription entitlement check with our billing and subscription providers so the App can determine whether your account already has premium access and, where applicable, restore that access across sessions or devices.

You can request deletion of your account at any time from within the App's Preferences screen. Account deletion removes your authentication account and cloud-synced app data, but does not automatically cancel any active subscription and does not affect billing or tax records that must be retained for legal or accounting purposes. 7. Premium Subscriptions, Billing, and Refunds

Prosper may offer auto-renewing premium subscriptions that unlock advanced features. By purchasing a subscription, you agree to the following terms:

  • Billing: Payment will be charged to your Apple App Store account, Google Play account, or processed through our web merchant of record, Paddle, as applicable at the time of purchase.
  • Auto-Renewal: Subscriptions renew automatically unless cancelled in accordance with the rules of the platform or billing provider through which the purchase was made.
  • Entitlement Recovery: The App may contact RevenueCat after sign-in, and on web also when you open premium-related flows, to determine whether your account already has an active entitlement and to manage subscription-linked access.
  • Management & Cancellation: You can manage or cancel subscriptions through your Apple App Store account settings, Google Play account settings, or the applicable web billing management portal. Deleting your Prosper account does not automatically cancel any active subscription.
  • Refunds: Refunds for Apple App Store and Google Play purchases are handled exclusively by those stores under their respective policies. Refund eligibility for web purchases processed by Paddle is governed by our Refund Policy, Paddle's terms, and applicable law.
  • Price Changes: We reserve the right to change subscription pricing. Any changes will apply prospectively and, where required, will be communicated before they take effect.

8. Cloud Data Sync

When you are signed in, the App may mirror your planning data (including app-level settings, per-profile settings, and snapshots) to a private area of Cloud Firestore associated with your account, so that you can recover it on another device. Cloud sync is optional and only occurs while you are signed in; signing out stops cloud sync and leaves local data on the device unchanged.

Cloud sync is provided on a best-effort basis. On first sign-in on a device where both local and cloud data exist, the App will ask you to choose which copy to keep as the baseline; the non-selected copy may be overwritten. Prosper and its developers are not responsible for any loss, corruption, or inconsistency of data resulting from network failures, conflict resolution choices, or interruptions to third-party cloud services. You are responsible for keeping your own independent copies of any data you consider important.

9. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Prosper and its developers expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Prosper does not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Prosper, its developers, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to financial losses, loss of data, loss of revenue, or business interruption, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.

In no event shall the total liability of Prosper and its developers to you for all claims arising from or relating to the App exceed the greater of (a) the total amount you paid for the App in the twelve months preceding the claim, or (b) €10 (EUR).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer protection rights under Portuguese and European Union law.

11. Intellectual Property

All intellectual property rights in the App, including but not limited to software, text, graphics, logos, and designs, are owned by or licensed to Prosper. You may not reproduce, distribute, or create derivative works from any part of the App without the prior written consent of Prosper.

12. License Grant

Subject to these Terms, Prosper grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or your access to it.

If you obtained the App through the Apple App Store, your use of the App is also subject to the Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you as a third-party beneficiary.

If you obtained the App through Google Play, your use of the App is also subject to the Google Play Terms of Service.

If you access the App through the web, your use is governed solely by these Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, except where mandatory consumer protection laws of your country of residence grant you the right to bring proceedings in your local courts.

14. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be accessed here.

15. Changes to These Terms

Prosper reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting within the App. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms.
